Terms of Service

1. The service
Bin Chutes is a project management platform designed for bin chute installation businesses. It allows teams to track floor-by-floor installation progress, manage bin room equipment, collect digital access panel handover signatures, upload reference photos, attach shop drawings, and generate PDF progress reports.
The Service is intended for use by businesses and professionals. It is not a consumer product and is not directed at individuals acting in a personal capacity.
2. Accounts and workspaces
To use Bin Chutes, a workspace owner must create a workspace and subscribe to a plan. Team members are then invited to join that workspace. By accepting an invitation, team members agree to these Terms.
You are responsible for maintaining the security of your login credentials. You must not share your credentials with others or allow unauthorised access to your account. You are responsible for all activity that occurs under your account.
You must provide accurate information when creating your account. Accounts created with false information may be suspended without notice.
You must be at least 18 years old to create an account or use the Service.
3. Subscriptions and payment
Access to Bin Chutes requires a paid subscription. Subscription plans, features, and pricing are described at binchutes.com/pricing. Prices are in Australian dollars and are exclusive of GST. GST will be added at checkout where applicable.
Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan chosen). Payment is processed by Stripe, Inc. on our behalf. By subscribing, you authorise recurring charges to your nominated payment method.
You may cancel your subscription at any time through your account settings or by contacting us at support@binchutes.com. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.
We reserve the right to change pricing with at least 30 days’ notice to existing subscribers via email.
4. Workspace archiving and data
When a subscription is cancelled, the workspace enters an archived state. During this period, workspace data (projects, buildings, floor records, photos, and signatures) is retained for 30 days. After 30 days, the workspace and all associated data are permanently deleted and cannot be recovered.
If you wish to export your data before cancelling, you should do so before your subscription ends. We are not liable for any loss of data following permanent deletion.
You may reactivate an archived workspace within the 30-day retention window by resuming your subscription. Contact support@binchutes.com if you need assistance.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to gain unauthorised access to any part of the Service or another user's account or workspace
- Upload content that is defamatory, obscene, or infringes the intellectual property rights of any third party
- Use the Service to store or transmit malware, viruses, or any other malicious code
- Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service
- Resell, sublicense, or otherwise commercially exploit access to the Service without our prior written consent
- Use automated scripts or bots to access or interact with the Service
We reserve the right to suspend or terminate accounts that violate these rules, without notice and without refund.
6. Uploads and file storage
The Service allows you to upload files including photos, drawings, and documents (“Uploaded Files”). Uploaded Files are stored using Cloudflare R2 cloud storage on our behalf.
Uploaded Files must be directly related to the construction or installation work being tracked in the Service — for example, site photos, shop drawings, access panel documentation, and bin room records. The Service must not be used as general-purpose file or image storage.
You must not upload files that:
- Contain illegal content of any kind, including but not limited to child sexual abuse material (CSAM), content that facilitates violence, or material that is illegal under Australian law or the laws of your jurisdiction
- Contain adult, explicit, or sexually explicit material
- Infringe the copyright, trademark, or other intellectual property rights of any person or organisation
- Contain personal information of individuals without their knowledge and consent
- Are unrelated to construction, installation, or the project management purpose of the Service
We reserve the right to remove any Uploaded Files that we determine, in our sole discretion, violate these Terms. Accounts found uploading prohibited content will be suspended or terminated immediately, without notice and without refund. We will report illegal content, including any CSAM, to the relevant authorities.
7. Your content
You retain ownership of all content you upload to the Service, including project data, photos, and documents (“Your Content”). By uploading content, you grant Daffi Labs a limited, non-exclusive licence to store, process, and display Your Content solely for the purpose of providing the Service to you.
You are responsible for ensuring that Your Content complies with Section 6 (Uploads and file storage) and does not violate any third-party rights or applicable law. You must have the authority to upload any personal information of third parties (such as client contact details or signatures) and must comply with all applicable privacy laws in doing so.
We do not claim ownership of Your Content and will not use it for any purpose beyond operating the Service.
8. Intellectual property
The Bin Chutes name, logo, app design, and underlying software are the intellectual property of Daffi Labs and are protected by Australian and international intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.
You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written permission.
9. Privacy
Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
The Service uses Google Firebase (database and authentication), Cloudflare R2 (photo and PDF file storage), and Stripe (payment processing). Use of the Service constitutes acceptance of the data practices of these providers as described in the Privacy Policy.
If you are a workspace owner, you are responsible for ensuring that your team members are aware of and agree to the Privacy Policy before you invite them to use the Service.
10. Availability and changes to the service
We aim to provide the Service with reasonable availability, but we do not guarantee uninterrupted or error-free operation. We may carry out maintenance, updates, or changes to the Service at any time.
We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service with reasonable notice where practicable. We will not be liable to you for any modification, suspension, or discontinuance of the Service.
11. Disclaimer and limitation of liability
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. To the maximum extent permitted by law, we disclaim all warranties, including fitness for a particular purpose and non-infringement.
Bin Chutes is a tool to assist with project management and record-keeping. It does not replace professional judgement. We are not responsible for decisions made based on information recorded in the Service.
To the maximum extent permitted by Australian law, our total liability to you for any claim arising out of or in connection with these Terms or the Service is limited to the amount you paid us in the 3 months preceding the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for any liability that cannot be excluded under the Australian Consumer Law.
12. Termination
You may stop using the Service and cancel your subscription at any time.
We may suspend or terminate your access if you breach these Terms, if your subscription payment fails and is not resolved within a reasonable period, or if we are required to do so by law. In cases of serious breach, we may terminate immediately without notice.
Upon termination, your right to access the Service ends immediately. Sections 7, 8, 11, and 13 survive termination.
13. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of New South Wales.
Before commencing any legal proceedings, we encourage you to contact us at support@binchutes.com to try to resolve the matter informally.
14. Changes to these terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will notify workspace owners by email at least 14 days before the change takes effect. Continued use of the Service after that date constitutes your acceptance of the updated Terms.
